The following text is intended to inform you about the extent and purpose for which the translation agency Anglisticus Worthington (hereinafter referred to as Anglisticus or we) collects and processes your personal data, as well as what rights you have when you visit the anglisticus.ch website, use services offered by Susan Worthington, or otherwise contact Susan Worthington. Please note that this privacy policy is subject to change at any time, so it may be worthwhile to review it regularly.

1. Responsibility for data processing

Susan Worthington is responsible for the collection, processing, and use of your personal data within the framework described above. We take data protection seriously and comply with the provisions of the Swiss Federal Data Protection Act (FDPA) and other data protection regulations that may apply, in particular the EU General Data Protection Regulation (GDPR). 2. Scope and purpose of processing personal data

a. When you visit our website

The website anglisticus.ch is operated with Wix Studio (Wix.com Ltd., Tel Aviv, Israel). Data processing takes place on servers outside of Switzerland, including in third countries (particularly the USA).

When you visit the anglisticus.ch website, the servers temporarily save each access in a log file. The following data is stored without your intervention:

  • the IP address of the requesting computer;

  • host name of the accessing computer;

  • the date and time of access;

  • browser type and version;

  • the operating system used;

  • referrer URL.

This data is collected and processed for the purpose of enabling the use of our website (establishing a connection) and to ensure system security and stability.

Only in the event of an attack on the network infrastructure or if there is suspicion of other unauthorized use of the website can the IP address be evaluated for investigation and defense purposes or used to identify the user in question in connection with civil or criminal proceedings.

We consider the purposes described above to be our legitimate interest in data processing.

b. As part of our service provision

Susan Worthington offers language services, particularly translation.

As part of pre-contractual measures and within the framework of contract execution, the names, addresses, email addresses and telephone numbers of customers and, if applicable, of the persons working for them are collected and processed.

Most of the texts we are asked to translate, as well as any accompanying documents related to these services, do not contain personal data. However, depending on the assignment, we may process personal data of third parties in the course of providing our services – including data that is considered particularly sensitive.

The legal basis for data processing is pre-contractual or contractual measures, your consent (if you are a client and your personal data is affected), or our legitimate interest in providing the service.

If you are a third party affected by our service provision and wish to exercise your data subject rights as outlined in Section 11, we will consult with the client to determine who qualifies as the data controller in the specific context and may refer you to the client accordingly.

c. When contacting us by email

You have the option to contact us via email.
You are responsible for the message and/or the content you send to us. Your information will be processed to the extent necessary to respond to your inquiries or to carry out pre-contractual or contractual measures.
The legal basis for processing your data is your consent or the performance of pre-contractual or contractual measures.

3. Google Analytics

We use Google Analytics on our website. This is a service provided by Google Ireland Limited, Google Building Gordon House, 4 Barrow St, Dublin, D04 E5W5, Ireland and Google Inc., 1600 Amphitheatre Pkwy, Mountain View, CA 94043-1351, USA (hereinafter both: Google). With Google Analytics we can measure and evaluate the use of the website - on a non-personal basis. Google uses permanent cookies for this purpose. Google does not receive any personal data from us, but can track your use of our website. This happens regardless of whether you are logged in with a Google account. If you are logged in with a Google account when you visit the website, Google can also assign the corresponding data to your Google account data. If you do not want this to happen, log out of your Google account beforehand. Google saves your data (even for users who are not logged in) as usage profiles and evaluates these. We do not receive any data in this regard, but we also have no influence on how Google uses the data. We have a legitimate interest in measuring the use of our website.

4. Disclosure of your data to third parties

We will only pass on your personal data if you have expressly consented, if there is a legal obligation to do so, or if this is necessary to carry out pre-contractual measures, to fulfil the contractual relationship (e.g. for the application of the four-eyes principle or for proofreading) or to enforce our rights.

The use of the relevant personal data by third parties is strictly tied to the relevant purposes (see section 2 above).

5. Transfer of personal data abroad, in particular to the USA

To the extent that we are permitted to pass on data to third parties, we may also transfer your data to third parties based abroad.

As far as the use of Google Analytics is concerned, data may be transferred to the USA (see sections 3-6 above).

For the sake of completeness, however, we would like to point out that the US authorities can take surveillance measures under US law that allow for the general storage of all data transmitted from the European Union or Switzerland to the USA.

Furthermore, we would like to point out that the US does not have an adequate level of data protection regarding personal data compared to the EU and Switzerland, and there is no effective legal protection comparable to that in the EU and Switzerland. [S1]

For the sake of completeness, however, we would like to point out that the US authorities can take surveillance measures under US law that allow for the general storage of all data transmitted from the European Union or Switzerland to the USA.

7. Retention periods

We only store personal data for as long as necessary to perform the services you have requested or to which you have given your consent, to protect our legitimate interests (such as pre-contractual measures) and to comply with our legal obligations.

The server log data remains stored as part of the backup for 10 years.

Please note that we are subject to statutory retention periods. Retention obligations that require us to retain data arise from accounting and tax regulations. According to these regulations, business communications, contracts, and accounting documents must be retained for up to 10 years.

8. Rights of data subjects

You have the following rights, depending on applicable data protection regulations. You can send your request to the address listed in section 1 above. Please note that we usually require proof of identity to process your request:

Right to information: You have the right to request access to your personal data stored by us at any time and free of charge. This gives you the opportunity to check which personal data we process about you and that we use it in accordance with applicable data protection regulations.

Right to rectification: You have the right to have inaccurate or incomplete personal data rectified and to be informed of the rectification. In this case, we will inform the recipients of the data concerned of the adjustments made, unless doing so is impossible or involves disproportionate effort.

Right to erasure: You have the right to have your personal data erased under certain circumstances.

Right to restriction of processing: Under certain circumstances, you have the right to request that the processing of your personal data be restricted.

Right of withdrawal: You generally have the right to withdraw your consent at any time. However, processing activities based on your consent in the past will not become unlawful as a result of your withdrawal.

6. Data security

We use appropriate technical and organizational security measures to protect your personal data stored with us against manipulation, partial or complete loss, and unauthorized access by third parties. Our security measures are continuously improved in line with technological developments. We have a legitimate interest in measuring the use of our website.
